Bitezor Terms and Conditions

These Terms and Conditions ("Terms") govern the access and use of the Bitezor platform, including our customer mobile application, vendor mobile application, delivery partner mobile application, backend API services, and associated websites (collectively, the "Platform") operated by Bitezor.
By downloading, registering, logging into, or using the Platform in any capacity, you agree to be legally bound by these Terms, the Bitezor Privacy Policy, and the Bitezor Refund & Dispute Resolution Policy. If you do not agree to these terms, you must not access or use the Platform.
1. User Eligibility and Account Registration
1.1 Customer Accounts
- Registration: To place orders on the Platform, you must register using a valid Indian mobile number and verify it via a One-Time Password (OTP) sent through our verification partner (Twilio).
- Age Limit: You must be at least 18 years of age to register or place orders on the Platform.
- Accuracy: You agree to provide accurate, current, and complete information, including delivery addresses, receiver names, and contact numbers.
1.2 Vendor Accounts (Merchants)
- Registration & Verification: Vendors must provide accurate details of their shop, including shop name, type, operating address, geo-coordinates, and vendor verification documents (such as Aadhaar card photos or shop registration certificates). Accounts are only activated upon platform verification.
- Catalog Management: Vendors are responsible for keeping their product menu, prices, descriptions, and availability status accurate.
- Payout Details: Vendors must register a valid UPI ID within their Vendor Earning Ledger to receive automated payouts processed through RazorpayX.
1.3 Delivery Partner Accounts (Gig Workers)
- Registration & Verification: Delivery partners must register using their mobile phone number and provide valid driver verification documents, including a driving license number, driving license photo, and vehicle registration images.
- Location Access: Delivery partners must grant continuous location permissions (including foreground and background location access) while online, which is used to calculate proximity, assign orders, and track deliveries.
- Reconciliation & Payouts: Partners must register a valid UPI ID for payout transfers via RazorpayX.
2. Platform Usage and Handoff Protocols
- Order Placement & Matching: The Platform connects customers with local vendors and nearby delivery partners using Redis-based geospatial matching.
- Dual-OTP Verification: To prevent incorrect handovers, fraud, and disputes:
- Pickup Handoff: The vendor must verify a pickup OTP with the delivery partner before releasing the food.
- Delivery Handoff: The delivery partner must verify a delivery OTP with the customer at the drop-off location to complete the order.
- Restrictions: Users shall not reverse engineer, decompile, scrape, or perform unauthorized security scans on Bitezor's backend systems or applications.
3. Financial Transactions, Earnings, and COD Settlements
- Payment Collection: Bitezor collects payments via Online Checkout (Razorpay) or Cash on Delivery (COD).
- Commission & Payouts: Vendor earning balances are credited with net earnings per completed order after deducting Bitezor's commission/platform fee.
- Delivery Earnings & Incentives: Delivery partner earning balances are credited with the order delivery charges and eligible daily performance incentive milestones.
- COD Cash & Outstanding Dues: When completing COD orders, delivery partners collect cash directly from customers, which debits their earning balance (creating outstanding dues). If a partner's cash debt exceeds the maximum outstanding dues limit set by Bitezor, order discovery is suspended until they settle the cash balance via the Razorpay payment portal inside the partner app.
4. Cancellations, Disputes, and Refunds
- Cancellation Rules: Orders paid online that are rejected by the restaurant or cancelled prior to preparation are automatically refunded.
- Dispute Window: Customers are encouraged to report issues (missing items, quality concerns, wrong orders) within a standard guideline of 2 hours of delivery via the in-app support ticketing channel, email (
support@bitezor.com), or WhatsApp (+91 9794829836). Bitezor reviews and retains discretion to process refunds past this window for genuine and verified delays. - Disbursement: Approved refunds for online payments are processed automatically via the Razorpay API to the original payment source. COD refunds are settled manually.
5. Account Deletion and Anonymization
- Data Erasure Requests: Any user (Customer, Vendor, or Partner) can request account deletion, which is verified via OTP.
- Operational Guardrails: Account deletion is blocked if the user has active orders, active delivery assignments, or an outstanding negative balance (unsettled COD cash).
- Anonymization: Upon approval, all personal identification data (name, phone, email, registration documents) is deleted or scrubbed, and the account is unlinked from transactional logs to protect privacy in compliance with the Indian DPDP Act (2023).
6. Intellectual Property Policy
All trademarks, logos, designs, software, codebase components (including backend systems and customer, vendor, and delivery partner application code), and branding associated with Bitezor are the exclusive property of Bitezor and are protected under Indian and international intellectual property laws. Any unauthorized reuse, reproduction, or reverse engineering of the Bitezor software is strictly prohibited.
7. Limitation of Liability and Indemnification
- Bitezor acts as a technology platform connecting customers, independent vendors, and independent delivery partners. Bitezor is not responsible for the quality, safety, or legal compliance of food prepared by vendors.
- Bitezor is not liable for indirect, incidental, or consequential damages arising from the use or inability to use the Platform.
- You agree to indemnify and hold Bitezor harmless from any claims, losses, or legal liabilities arising from your violation of these Terms or misuse of the Platform.
8. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of the city in which Bitezor operates its registered office.
